Property Settlements
When you need a Family Lawyer or Mediator in Taree or the Mid-Coast area - Call Us - we can help
Not everyone needs a family lawyer for their post-separation property settlement. However, we always recommend that each person consult with a lawyer prior to making any agreement or filing an application with the Court. The reason is there are often issues that you may not realise are important to your circumstances.
The calculation of property settlements after separation is not a "precise science" and, as a result, it's our job as your lawyer to advise you about the range of different outcomes you might expect, especially from the Court, and apply them to your particular circumstances so that any decision you make is an informed decision.
When considering your options for settling your post-separation property matters, there are several settlement options available to you, but they mainly fall into two broad categories:
1) by agreement; or
2) contested; and
in some cases, couples may explore two or more options before they finally reach an agreement.
First, a property settlement resolved by agreement is one that the parties have been able to agree between themselves either entirely on their own, or with the assistance of their lawyers, or using a Dispute Resolution process.
Second, a property matter that is contested is when no agreement was reached using other means and it has become necessary to ask the Court to intervene. However, even contested property settlements in Court can be resolved by consent at any time. But if you can discuss and come to an agreement yourselves, we can assist you to correctly record any agreement you have reached. Because any agreement made between separating couples needs to be in writing and in the proper form. There are several reasons why this is important. Whether you need simple one-off advice or assistance through complex legal cases, we offer personal, professional, and cost effective legal and mediation services to help you through this time in your life.
